Family Matters FAQs

Q. How long will my divorce take?

A. It is difficult to be precise as it depends on how co-operative the other party is and how promptly they respond to the proceedings.

Q. Am I committing adultery when I only started the relationship after we separated?

A.Yes, because although you are separated, you are still married.

Q. I want a divorce but have only been married a few months?

A.You must have been married a year before you can be divorced.

Q. I receive working families tax credit, will I be eligible for Legal Aid?

A.You do not automatically qualify financially for Legal Aid with this benefit. Only Income Support, income based Job Seekers Allowance and guaranteed State Pension Credit give an automatic entitlement to legal aid.
